The terms that apply when you use the Francis Web Agency website or engage us for a project.
These Terms of Service (“Terms”) cover your use of the Francis Web Agency website and the services we provide. By using this site or hiring us, you agree to them.
1. Our services
Francis Web Agency provides web design, web development, custom web application development, search engine optimization, website management plans, and AI receptionist services. The exact work, timeline, and price for any project are set out in a written proposal or agreement, which takes precedence over general statements on this site.
2. Quotes and proposals
Prices listed here, including “starting at” package prices, are starting points, not final quotes. Your final price is set in your proposal, based on scope. A project begins once you've approved the proposal and paid the deposit.
3. Payment
- Website projects are billed 50% deposit to start and 50% on completion, unless your proposal says otherwise.
- Website Support Plans are billed monthly, in advance, at the rate for your chosen tier (Essential, Plus, or Pro).
- Invoices are due on the terms stated. Late or missed payments may pause work or active services until they're resolved.
4. Your responsibilities
To keep a project on schedule, you agree to provide the content, access, and feedback we need in a timely way, and to make sure you have the rights to any text, images, or materials you hand us.
5. Revisions and scope
Each proposal defines what's included. Work beyond that scope (extra pages, new features, or requests outside your support plan) is quoted and approved before we start it.
6. Ownership and intellectual property
When your project is paid in full, you own the final website and its custom content. We keep ownership of any pre-existing tools, code libraries, or components we reuse across projects, and we may show the finished work in our portfolio and marketing unless you ask us in writing not to. You're responsible for holding the rights to anything you provide us.
7. Third-party services
Projects often rely on third-party services: hosting, domains, plugins, and the like. Their terms and fees are separate from ours, and we're not responsible for outages or changes on their end.
8. Support plans
Website Support Plans renew monthly until cancelled. You can cancel or change your plan with reasonable notice; cancelling stops future billing but doesn't refund the current period, and unused content-edit time doesn't roll over.
9. Results and warranties
We build to a high standard and follow current best practices, but we can't guarantee specific outcomes like search rankings, traffic, or revenue; those depend on factors outside our control. Our services and this site are provided “as is,” without warranties of any kind, to the extent the law allows.
10. Limitation of liability
To the fullest extent the law allows, Francis Web Agency isn't liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid us for the work the claim relates to.
11. Termination
Either of us can end a project with written notice. If you end one partway through, you're responsible for the work completed up to that point, and deposits are non-refundable once work has started.
12. Governing law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules.
13. Changes to these terms
We may update these Terms from time to time. Continuing to use the site or our services after a change means you accept the updated Terms.
